El Supremo ve hoy el primer recurso de una empresa por la OPS de Bankia

La Sala de lo Civil del Tribunal Supremo estudiará hoy el primer recurso de casación presentado por grandes inversores que participaron en la salida a Bolsa de Bankia del año 2011 y reclaman ser indemnizados como los fueron los minoristas. El fallo se conocerá dentro de unos días.

El recurso que estudiará es el presentado por la compañía de seguros Umas. En total recurrieron al Tribunal Supremo una docena de empresas, a las que se aplicará la jurisprudencia que marque el alto tribunal. Entre ellas se encuentra una empresa del Grupo Villar Mir, Porcelanosa y Disa, controlada por Demetrio Carceller. Todos ellas han perdido contra Bankia en primera o segunda instancia. Iberdrola también, pero ha abandonado la pelea judicial.
Según Fieldfisher JAUSAS, esta sentencia es clave. “Puede incentivar o desincentivar a las empresas a reclamar en tribunales por pérdidas por productos financieros”, explica Pablo Franquet, socio del despacho.
